1. Overview
This Data Processing Addendum ("DPA") is part of the Terms of Service between Leveraging AI, LLC, operating as ChatifyIT ("ChatifyIT," "we," "us"), and you, the creator using ChatifyIT ("Customer," "you").
It applies when we process personal data on your behalf through the Service, for example the emails your AI guides collect from visitors, and that data is covered by data protection laws such as the EU and UK GDPR or U.S. state privacy laws.
2. Roles
You (the controller)
You decide why and how the personal data your guides collect is used. You are responsible for:
- Having a legal basis, and any consent needed, to collect and use visitors' emails
- Giving visitors any privacy notice the law requires
- How you use the data after you export it or send it to other tools
- Responding to visitors' requests about their data
ChatifyIT (the processor)
We process that personal data only to provide the Service and on your instructions, which are your settings in ChatifyIT and these Terms. We will:
- Keep it confidential and use it for no other purpose
- Protect it with appropriate security measures
- Use only the subprocessors listed on our Subprocessors page
- Help you respond to data requests and meet your legal obligations, where reasonable
3. The data we process
Types of personal data
- Email addresses visitors choose to share with your guides
- Which guide collected each email, and when
- Visitors' chat messages, only while the chat is happening, to generate replies. We don't store conversations.
- The notice each visitor was shown when sharing their email, and when (a record of consent)
People the data is about
Visitors to your ChatifyIT page who chat with your guides or share their email.
What we do with it
- Send chat messages to our AI providers to generate your guide's replies
- Store collected emails in your lead list
- Let you view and export them
- Send them to email marketing tools you connect, such as Systeme.io, when you set that up
- Keep backups for recovery
4. AI processing
Your guides identify themselves to visitors as AI. Chat messages are processed by our AI providers (currently Anthropic and OpenAI) under business terms that don't allow them to train their models on this data. We don't use your visitors' data to train AI models.
5. Security
- Encryption in transit (HTTPS/TLS)
- Encrypted storage at our database provider
- Access limited to people who need it to run the Service
- Secure sign-in and access controls
- Backups held by our infrastructure providers
6. Subprocessors
You authorize us to use the subprocessors listed at chatifyit.com/subprocessors. Each is bound by data protection terms. We'll update that page and email account holders before adding a new subprocessor that processes this data. If you object on reasonable data protection grounds, tell us at hello@chatifyit.com; if we can't address your concern, you may cancel your plan.
7. Visitors' requests
You can view and export the emails your guides collect in your ChatifyIT dashboard. Visitors stop your emails through the unsubscribe link in the emails you send, or by contacting you. To delete a visitor's email, or all of your data, email us at hello@chatifyit.com and we'll delete it. If a visitor contacts us directly about data you collected, we'll pass the request to you.
8. Deletion
We delete your data, including your collected emails, when you ask us to. Please export anything you want to keep first. Deleted data may remain in encrypted backups for a limited time before it's overwritten.
9. Data breaches
If we become aware of a breach affecting personal data we process for you, we'll notify you without undue delay, explain what happened and what data was affected, describe what we're doing about it, and help you meet any notification duties you have.
10. International transfers
ChatifyIT is based in the United States, and data is processed in the United States and other countries where our subprocessors operate. Where the law requires, transfers rely on safeguards such as the Standard Contractual Clauses in our subprocessors' data protection terms.
