1. Agreement to these terms
These Terms of Service ("Terms") are a legal agreement between you and Leveraging AI, LLC, a Florida limited liability company operating as ChatifyIT ("ChatifyIT," "we," "us," or "our"), for your use of chatifyit.com and the ChatifyIT platform (the "Service").
By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and, where it applies, our Data Processing Addendum. If you don't agree, don't use the Service.
2. What ChatifyIT is
ChatifyIT is a link-in-bio platform. Depending on your plan, you can:
- Build a public page at chatifyit.com/yourname
- Run AI guides that chat with your visitors and collect the emails of people who choose to share them
- Sell products through your own Stripe account
- Share links, recommendations (including affiliate links), and a booking link
- Export collected emails or send them to email marketing tools you connect
- Draft and publish social media posts ("Releases")
We may add, change, or remove features over time.
3. Your account
You must be at least 18 and able to enter a binding contract. You're responsible for keeping your login details safe, for all activity on your account, and for keeping your account information accurate. Tell us right away at hello@chatifyit.com if you think someone has accessed your account.
When you create an account, we record the date and the versions of these Terms and our Privacy Policy you agreed to.
Your username is yours to use while your account is active. We may reclaim a username that is inactive, misleading, or infringes someone else's rights.
4. Plans, trials, and billing
4.1 Plans
ChatifyIT offers paid plans (currently Starter, Growth, and Pro), billed monthly or yearly. Each plan's price, features, and limits, such as the number of AI guides and the number of new emails your guides can collect each month, are shown on our pricing page when you sign up. When you reach your monthly limit of new emails, your guides stop collecting new emails until the next month starts, or until you upgrade.
4.2 Free trials
- Plans start with a free trial. A payment card is required to start one.
- Your trial length is shown at checkout. It's usually 10 days; some offers give longer trials.
- If you don't cancel before your trial ends, your plan starts automatically and your card is charged. We'll send a reminder before a trial ends where our payment provider supports it.
- Free trials and special offers are for new customers unless we say otherwise, and are limited to one per person or business.
4.3 Automatic renewal
Your plan renews automatically at the end of each billing period (monthly or yearly) until you cancel. You authorize us and our payment provider, Stripe, to charge your payment method for each renewal.
4.4 No refunds
All payments are final and non-refundable, including partial months, unused time, and yearly plans, except where the law requires otherwise. Cancelling stops future charges; it doesn't refund past ones.
4.5 Cancelling
You can cancel at any time from your account settings. When you cancel, we may ask why you're leaving and may offer you a discount or free time to stay; each offer is available once per customer. Your cancellation takes effect at the end of your current billing period, and you keep access until then.
4.6 Price changes, taxes, and failed payments
We may change our prices with at least 30 days' notice by email. The new price applies from your next billing period after the notice. Prices don't include taxes unless stated. If a payment fails, we may pause or limit your account until it's resolved.
5. Referral offers and programs
5.1 Give a month, get a month
- Members can share a referral link. A friend who is a new customer and signs up through it gets a 30-day free trial.
- After the friend's first paid payment, the member who referred them gets one free month of credit, worth the cheaper of the two plans. Credit is applied to the member's ChatifyIT bill and has no cash value.
- Members can earn up to 6 free months in any 12 months. You can't refer yourself or another account you control.
- If a friend signs up through an affiliate link, the affiliate program applies instead, and this offer doesn't.
5.2 Founding Creators
Founding Creators is an invitation-only offer with a longer free trial, as shown on the offer page at the time you join. If you upgrade during your free time, your remaining free time may be shortened as shown at checkout. Being featured in our Founding Creators spotlight is at our discretion and requires the eligibility shown on the offer page, such as follower count and a complete page.
5.3 Affiliate program
Our affiliate program has its own Affiliate Terms.
5.4 Changes
We may change or end any offer or program at any time. Changes won't take away rewards you've already earned.
6. AI guides and AI-generated content
- AI disclosure: every AI guide tells visitors up front that it's an AI guide. You must not remove, hide, or contradict this, or present a guide as a real person. This helps meet laws such as the EU AI Act.
- Accuracy: AI can make mistakes. You're responsible for your guides' instructions and content, and for checking that what they say is accurate and appropriate.
- Professional advice: don't present a guide's answers as medical, legal, financial, or other professional advice from a licensed professional.
- AI-written posts: review AI-written posts before you publish them, and label AI-generated content where the law or a platform requires it. You're responsible for what you publish.
- AI providers: guides run on third-party AI providers (currently Anthropic and OpenAI), and their usage policies apply to content created through the Service.
7. Collecting emails and email marketing
Your guides collect emails from visitors who choose to share them. When a visitor shares their email, the guide tells them that you will send them emails and that they can unsubscribe anytime, and we save what they were shown. You must not remove, hide, or change this notice. For the emails you collect, you are responsible for:
- Telling people how you'll use their email, and getting any consent the law requires
- Following email marketing laws such as CAN-SPAM, CASL, and GDPR
- Including a working unsubscribe link in every marketing email you send
- Honoring unsubscribe and deletion requests promptly. ChatifyIT doesn't send emails to your visitors, so unsubscribing happens in your email tool or through you.
For these emails, you decide how they're used (you are the "controller"), and we process them on your behalf (we are the "processor") under our Data Processing Addendum.
8. Selling in your shop
- Shop sales are processed on your own Stripe account. You are the seller; ChatifyIT is not a party to the sale.
- ChatifyIT charges no fee on your sales. Stripe's own processing fees apply.
- You're responsible for your products, delivery, customer service, refunds, chargebacks, taxes, and following the law.
- Stripe's terms apply to your Stripe account. Shop checkout needs an active ChatifyIT plan and stops working if your plan ends.
9. Links and recommendations
You're responsible for the links you share. If you earn money from a link, such as an affiliate link or a sponsored recommendation, you must disclose it as the law requires, for example under the FTC's endorsement guides.
10. Acceptable use
You agree not to use the Service to:
- Break any law or regulation
- Sell illegal, counterfeit, or harmful products or services
- Send spam or unwanted messages
- Collect sensitive information through a guide, such as health information, government ID numbers, or financial account numbers
- Mislead people, including by making a guide pretend to be a human
- Harass, threaten, or harm others, or target content at children
- Infringe anyone's copyright, trademark, or other rights
- Spread malware, or try to break into, overload, copy, or scrape the Service
- Resell the Service without our written permission
We may remove content or suspend accounts that break these rules.
11. Content and ownership
Your content: you own the content you add to ChatifyIT, including your page, products, guide instructions, and the emails you collect. You give us a limited license to host, display, and process it only to run the Service for you. You confirm you have the rights to everything you upload.
Our property: the Service, including our software, design, and the ChatifyIT name and logo, belongs to Leveraging AI, LLC. You may not copy or reuse it without permission.
Feedback: if you send us ideas or suggestions, we may use them without any obligation to you.
12. Other services
The Service works with other companies' services, such as Stripe, AI providers, email marketing tools, social networks, and Rewardful. Their terms apply when you use them, and we're not responsible for them.
13. Availability
We work to keep ChatifyIT running, but we don't promise it will always be available or error-free. It may be unavailable for maintenance, updates, or reasons outside our control.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL MEET YOUR NEEDS, THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE.
15. Limitation of liability
TO THE MAXIMUM EXTENT THE LAW ALLOWS, LEVERAGING AI, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
16. Indemnification
You agree to defend and hold harmless Leveraging AI, LLC and its owners and team from claims, losses, and costs (including reasonable legal fees) arising from your use of the Service, your content and guides, your shop sales, your use of collected emails, or your breaking these Terms or the law.
17. Ending your account
By you: you can cancel your plan at any time (see section 4.5). To have your account and data deleted, email hello@chatifyit.com from your account email.
By us: we may suspend or close your account if you break these Terms, don't pay, act fraudulently, or put other users or the Service at risk.
What happens: when your account ends, your page, guides, and shop go offline. Export your collected emails before then. Payments already owed remain due.
18. Changes to these terms
We may update these Terms. We'll post the new version here and update the date at the top, and email account holders about significant changes. Continuing to use the Service after changes take effect means you accept them.
19. Governing law and disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules.
Informal resolution first: before starting a formal dispute, contact us at hello@chatifyit.com and give us 30 days to try to resolve it.
Arbitration: any dispute that isn't resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its rules, in Orlando, Florida, or remotely. Either party may go to court to stop infringement of intellectual property or unauthorized access to the Service.
Class action waiver: YOU AND WE AGREE TO RESOLVE DISPUTES ONLY INDIVIDUALLY, NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
20. General
These Terms, with the documents they mention, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a right, we haven't given it up. You may not transfer these Terms without our consent; we may transfer them. We're not responsible for delays caused by events beyond our control.
